ARTICLE 1: scope of the general conditions of sale

The customer declares to have read and accepted the present conditions of sale, at the

later when ordering

Consequently, any clauses to the contrary or any general conditions of purchase emanating from

of the buyer are unenforceable against ARTEM by NOVIREV, except with the prior written consent of

this one.

Article 2: formation of contract

All orders must be the subject of an order confirmation established by Artem

ARTEM by NOVIREV according to the indications given by the customer. The contract will be deemed

formed upon receipt by the customer of this confirmation.

Any possible modification of the order must be accepted by ARTEM by NOVIREV and

will be the subject of a new order confirmation.

Article 3: delivery

ARTEM by NOVIREV subcontracts the transport of its goods

For all goods in stock in our depots, the goods are shipped within

eight days from the establishment of the order form or receipt of confirmation

signed order.

In the event of an order relating to a volume or a type of goods not presented in

stock, dispatch will take place within 6 to 8 weeks of the establishment of the good

of order and the acknowledgment of receipt of said order. In any event, the deadlines

mentioned above are indicative only, and any delay in delivery will not

may lead to the dissolution of the contract and the award of damages.

Any delay in shipment due to our manufacturer or force majeure cannot

lead to the dissolution of the contract or the awarding of damages. The goods

are delivered to the place designated by the customer in the order form, unless otherwise ordered in writing

addressed to Artem and emanating from the client or his agent and in particular the installer before

departure of the goods from the place of dispatch.

Any complaint must be made within a maximum period of 7 days from the

delivery, under penalty of inadmissibility.

Article 4 : transport

We decline all responsibility for damage, delay or missing items and, therefore,

do not agree to take charge of the damages that could be due to us

requested by our recipient. The latter alone has the capacity to assert his rights with the

carriers and we urge him, if necessary, to make the necessary reservations to

reception.

Article 5: complaints

Only complaints made in writing, within eight days of receipt of the

goods, will be taken into account. Under no circumstances will we accept the return of our

materials if a defect, visible on receipt, is reported to us after installation or cutting.

We do not guarantee the uniformity of baths between parts of the same quality and

same color. Any return of goods must obtain our prior agreement.

In the event of replacement of the defective goods, we do not take charge of the

cost of removal and refitting of the exchanged material. We decline all responsibility for

subject of the articles of our manufacture whose employment would not be in conformity with our

usage recommendations.

Article 6: retention of title

ARTEM by NOVIREV retains ownership of the goods sold until effective payment of

the full price in principal and accessory.

Article 7: terms of payment

Unless otherwise agreed by the company at the time of the order, payments are made from the

next way

• cash payment 50% on order 50% on delivery

ARTEM by NOVIREV reserves the right to demand full payment with the order or

guarantee of payment in respect of customers presenting a financial risk.

Article 8: late penalties

In the event of stipulation of payment terms, failure to pay on the due date

automatically incur default interest on the buyer, the rate of which is equal to 3 times the rate

of legal interest. It will be the same for the delay of the payment of the balance on delivery.

Article 9 : guarantee

ARTEM by NOVIREV only guarantees defects, material or manufacturing defects in the

products it distributes, under the legal conditions referred to in articles 1641 and following of the

civil Code. In each quote for its products, ARTEM by NOVIREV includes:

• a description of the characteristics of the product

• an installation advice leaflet with glue recommendations

• a notice of cleaning instructions.

It is up to the customer or installer to ensure the presence of these different notices on

each estimate or order confirmation, and in the event of their absence,

complain to ARTEM by NOVIREV before any installation or cleaning.

The principles of installation, use and cleaning as defined in the instructions are

imperatives. ARTEM by NOVIREV excludes its guarantee in the event of non-compliance with the prescriptions.

Article 10: jurisdiction

Any dispute relating to this sale, even in the event of warranty claims or pluralities

of defenders, will be under the exclusive jurisdiction of the Commercial Court, within the jurisdiction

which is the headquarters of ARTEM by NOVIREV.
